Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Stocked Scout at stockedscout.com and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Stocked Scout helps you discover nearby fishing waters and related public information such as stocking announcements, boat access, weather, and water levels. The Service may also include Community features that let verified users share catch photos, captions, lake tags, and related social features (such as follows and comments). Coverage currently focuses on California, Arizona, Texas, New York, North Carolina, Montana, Alaska, and Michigan and may change over time.
2. Accounts
- You must provide a valid email address and keep your login credentials secure.
- You are responsible for activity under your account.
- Free accounts may follow a limited number of lakes. Email stocking alerts and additional features are available on Premium, as described on the Premium page.
- Community posting may require a verified email address. We may change eligibility rules over time.
- We may suspend or terminate accounts that violate these Terms or abuse the Service.
3. Acceptable use
You agree not to:
- Scrape, bulk-copy, or overload the Service or upstream public data providers in ways that harm availability.
- Attempt to access accounts, systems, or data you are not authorized to use.
- Use the Service for unlawful purposes or to harass, threaten, or dox others.
- Misrepresent stocking, access, or safety conditions as if they came from an official agency warranty.
- Post spam, malware, or content intended to disrupt the Service.
- Upload content you do not have the right to share (including photos you do not own or lack permission to use).
4. Community content
If you use Community features, you are solely responsible for the content you submit (including photos, captions, lake names, and comments). Community posts reflect user experiences and opinions. They are not stocking notices, official regulations, or agency guidance. Always confirm rules, access, seasons, and conditions with the relevant agency or facility before you go.
When you post Community content, you agree that:
- You own the content or have all rights needed to post it.
- Your content does not violate law, these Terms, or others’ privacy or publicity rights.
- You will not post private-property access tips that encourage trespass, illegal take, protected locations meant to stay confidential, or other harmful guidance.
- You will not include personal information about other people without permission.
- Photos and captions may be visible to other users of the Service.
You retain ownership of your content. You grant Stocked Scout a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as needed to operate and improve the Service (including moderation, backups, and showing your posts in feeds). This license ends when you delete the content or your account, except for reasonable residual copies in backups or caches that are deleted in the ordinary course, and except where we must retain material for legal or security reasons.
We may (but are not obligated to) review, hide, remove, or restrict Community content or accounts at any time for any reason, including reports from other users. We do not guarantee that every post is reviewed before it appears. Reporting tools help us prioritize review; they do not create a duty to monitor all content.
5. Public data disclaimer
Stocked Scout is not affiliated with, endorsed by, or officially connected to the California Department of Fish and Wildlife (CDFW), the Arizona Game and Fish Department (AZGFD), the Texas Parks and Wildlife Department (TPWD), the New York State Department of Environmental Conservation (NYSDEC), the North Carolina Wildlife Resources Commission (NCWRC), Montana Fish, Wildlife & Parks (MT FWP), the Alaska Department of Fish and Game (ADF&G), the Michigan Department of Natural Resources (MI DNR), or other agencies whose public data we reference. Stocking schedules, lake details, boat ramps/rentals, weather, and water levels are compiled from third-party public sources (including CDFW, AZGFD, TPWD, NYSDEC, NCWRC, MT FWP, ADF&G, MI DNR, NWS, and USGS) and may be incomplete, delayed, or incorrect. Always confirm rules, access, and conditions with the relevant agency or facility before you go. Stocked Scout is an informational tool, not an official government notice. Community posts from other users likewise are not agency notices.
You are solely responsible for verifying that you have lawful access to any water or property, obtaining any required licenses or permits, and complying with all applicable fishing, boating, and land-use regulations for that state and waterbody. A listing, map pin, classification, or stocking note on Stocked Scout does not grant access, guarantee public entry, or replace official regulations.
6. Premium subscriptions & billing
- Paid plans are billed through Stripe according to the plan you select (monthly or yearly).
- Prices and promotions shown at checkout are part of your purchase.
- You can manage or cancel renewals through the billing portal linked from your Premium page when Stripe is configured.
- Unless required by law, fees already paid are non-refundable, except where we state otherwise for a specific offer.
7. Intellectual property
The Stocked Scout name, branding, site design, and original software are owned by us or our licensors. Public agency datasets remain subject to their own terms and attribution requirements. You may not copy the Service for a competing product without permission. Community content remains owned by its posters, subject to the license in Section 4.
8. Copyright complaints
If you believe content on the Service infringes your copyright, email Stocked Scout <noreply@stockedscout.com> with a description of the work, the URL or location of the material, your contact information, and a good-faith statement that you are authorized to act. We may remove or disable access to material and, where appropriate, notify the poster.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or the accuracy of third-party fishery, weather, or gage data, or of Community content submitted by users.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, STOCKED SCOUT AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR TRAVEL COSTS ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY CONTENT (INCLUDING COMMUNITY CONTENT). OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
11. Indemnity
You agree to defend and indemnify Stocked Scout and its operators from claims arising out of your misuse of the Service, your Community content, or your violation of these Terms, to the extent permitted by law.
12. Privacy
Our collection and use of personal information is described in the Privacy Policy.
13. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes means you accept the updated Terms. If you do not agree, stop using the Service and cancel any Premium subscription. When we make material changes related to Community, we may also ask you to re-confirm acceptance where practical.
